AOA Battles Red Flags Rule Implementation, Similar Concerns in Financial Overhaul Bill

With a June 1 enforcement date fast approaching, AOA continues to push for a permanent exemption for optometry practices from the overly burdensome Red Flags identity theft rule.

Under legislation passed in 2003, businesses determined to be “creditors” would be required to implement appropriate programs to prevent and detect identity theft.

The regulation is targeted primarily at banks and other financial institutions. However, the Federal Trade Commission (FTC) has indicated that optometry and other health care practices fit within the legislative definition of “creditors” and would be required to comply. Medicare Update: CMS to Begin Paying Claims at Proper Rate Today

On April 15, 2010, President Obama signed into law the “Continuing Extension Act of 2010,” which extends through May 31, 2010, the zero percent update to the Medicare Physician Fee Schedule that was in effect for claims with dates of service January 1, 2010 through March 31, 2010. The law is retroactive to April 1, 2010. Click here to read the full report from the AOA Washington Office team.

Consequently, effective immediately, CMS has announced that claims with dates of service April 1 and later, which were being held by Medicare contractors, are being released for processing and payment. The Medicare agency has also asked doctors to keep in mind that the statutory payment floors still apply and, therefore, clean electronic claims cannot be paid before 14 calendar days after the date they are received by Medicare contractors (29 calendar days for clean paper claims). As AOA Continues Push for Lasting Reform, Congress Approves 2-Month Retroactive Medicare Pay “Patch”

Congress has approved an AOA-backed bill that would retroactively reverse a massive cut in Medicare payments to optometrists and other physicians. The 21 percent cut was scheduled to take effect Apr. 1; however, the measure approved by Congress today would overturn the steep cut and freeze Medicare payments at pre-cut levels through May 31.

After overcoming an important procedural hurdle late Monday and extended debate in the following days, the U.S. Senate gave final approval to the Continuing Extension Act (HR 4851) today by a vote of 59-38. The bill, which passed the U.S. House on Mar.17, would also extend long-term unemployment benefits, COBRA health insurance subsidies for jobless workers, a national flood insurance program and the use of 2009 poverty guidelines for federal programs. Congress Fails to Prevent Apr. 1 Medicare Pay Cut, ODs Urged to Hold Medicare Claims

Despite objections raised by the AOA and other patient and provider groups, Congress has failed to prevent a massive 21 percent cut in Medicare physician reimbursement from taking effect Apr. 1 (see Mar. 29 article).

As a result of this inaction, the AOA Washington Office has advised ODs to hold claims, if possible, with dates of service on or after Apr. 1, until Congress completes action on AOA-backed legislation to correct these drastic cuts in Medicare physician payments. AOA expects Congress to address this issue quickly when lawmakers return to Washington, D.C. next week.

The U.S. Centers for Medicare & Medicaid Services (CMS) has instructed its contractors to temporarily hold fee-for-service claim processing for 10 days; anticipating Congress will once again intervene to prevent the planned cuts. CMS will not process claims (with dates of service in April) for 10 days, but still expects to make payments within legal limits of 14 days (electronic claims) or 29 days (paper claims).
